Supreme Court Rejects Request to Revoke Tamil Nadu Governor RN Ravi’s Appointment

Published

on

On Monday, the Supreme Court declined to hear a petition requesting a directive to the Secretary of the President of India for the recall of Tamil Nadu Governor R.N. Ravi. This came after the Governor walked out of the Legislative Assembly on January 6 without delivering his traditional address.

Chief Justice Sanjiv Khanna, presiding over a bench that included Justice Sanjay Kumar, described the petition as “ill-conceived,” stating that the court cannot issue directives for the removal of a Governor by the Secretary of the President of India.

Governor Ravi exited the Assembly during the singing of the Tamil Nadu state anthem, Tamil Thai Vazhthu, prior to his customary address, claiming that the national anthem had not been played as he had requested.

The plea, submitted by advocate C.R. Jaya Sukin, remarked, “The Governor has now achieved a hat-trick of walkouts from the Legislative Assembly. He asserted that the national anthem was not played before his official address, leading to the singing of Tamil Thai Vazhthu instead.”

Reports indicate that Governor Ravi created a stir by leaving the state assembly before delivering his opening address. He has alleged that, despite several requests, the national anthem was not performed before the assembly convened for its first session of the year.

The petition referenced constitutional provisions, arguing that Article 153 mandates a Governor for each state, while Article 155 states the President appoints the Governor. Article 163 outlines that a Council of Ministers should aid and advise the Governor. The plea contended that it is not within the Governor’s prerogative to dictate the order of the national anthem’s performance.

“Governor R.N. Ravi has now breached numerous provisions of the Indian Constitution. The traditional address by the Governor at the start of a new year’s session is becoming increasingly inappropriate,” the plea claimed.

Since assuming the role of Tamil Nadu Governor, Ravi has made several politically controversial statements, undermining the impartiality expected of his office. He has referred to the Dravidian model of governance as “an expired ideology,” as noted in the petition.

Moreover, the plea accused Governor Ravi of delaying legislation by either withholding assent to bills or sending them back. It argued that the Governor has recurrently criticized Dravidian culture and governance, asserting that he ought to remain apolitical and strictly perform the constitutional duties assigned to him.
