Setback for EPS as High Court Removes Stay on Election Commission’s Decision in AIADMK Leadership Dispute

Former Tamil Nadu Chief Minister E.K. Palaniswami faced a setback on Wednesday as the Madras High Court authorized the Election Commission to address petitions regarding intra-party disputes within the AIADMK and to evaluate the legitimacy of the current leadership.A Division Bench of Justices R. Subramanian and G. Arul Murugan lifted the stay that had been imposed last month on further proceedings by the Election Commission concerning representations from expelled AIADMK members, including former MP P. Ravindranath, the son of ex-Deputy Chief Minister O. Panneerselvam (OPS), who leads a splinter group.

Other individuals, such as former MP K.C. Palanisamy and V. Pugazhendi, had also approached the Election Commission. The previous stay was granted following a petition from EPS, questioning the standing of the petitioners since they had been expelled from the party, as well as the Election Commission’s authority to intervene in what it considered a settled intra-party matter.

The Election Commission now faces the decision of either rejecting the petitions or potentially freezing the iconic ‘Two Leaves’ symbol of the AIADMK, which could prevent EPS from using it ahead of the 2026 assembly elections. In July 2021, EPS was appointed as the party’s general secretary by the General Council, solidifying unitary leadership after OPS and his supporters were expelled from the party during that same assembly.

EPS currently has the backing of 61 out of 65 AIADMK MLAs in the Tamil Nadu assembly and is supported by over 2,900 members of the General Council.

In vacating the stay, the Bench instructed the Election Commission to conduct its inquiry into the petitions solely based on the guidelines outlined in paragraph 15 of the Elections Symbols (Reservation and Allotment) Order, 1968, before taking any further action.

This instruction ensures that the Election Commission first determines whether a dispute genuinely exists among the parties through an initial hearing. Only after this preliminary assessment can the Election Commission decide if it has the authority to proceed further. If factions are found to have formed due to a split, the Election Commission has the power to determine which faction represents the party and is entitled to the party symbol.

The initial petition to freeze the AIADMK symbol was submitted to the Election Commission by S. Surya Moorthi in February last year, ahead of the Lok Sabha elections, citing ongoing civil litigation concerning the leadership dispute. He also sought a directive from the High Court to compel the Election Commission to act on his representation, which was dismissed in December when the Election Commission promised to make a decision within four weeks. Subsequently, the Election Commission issued notices to the AIADMK and other expelled members who had made representations, resulting in EPS’s challenge in the High Court.

During the stay granting proceedings, Justice Subramanian had questioned the Election Commission’s ability to intervene in intra-party civil disputes that were already before the High Court. The counsel for the Election Commission indicated that it had yet to determine whether it possessed the jurisdiction to consider those representations.

Man Killed by Wife’s Lover in Andhra Pradesh, Son Raises Alarm

Andhra Pradesh: A 45-year-old man was killed by his wife’s lover in Annamayya district of Andhra Pradesh. The incident happened on Monday night in a forest area near Chowdepalli.

The victim, Gandhi from Tamil Nadu, had come with his five-year-old son to search for his wife. Police said the wife was in a relationship with another man named Narasimhulu.

Narasimhulu allegedly took Gandhi and the child into the forest. He and his aides then attacked Gandhi with a stone and killed him in front of the boy.

The frightened child hid in nearby bushes. After the attackers left, he stayed beside his father’s body the whole night.

At sunrise, the boy walked to a nearby village and informed locals. The police were alerted and started an investigation.

Police have taken the accused and his two aides into custody. The child has been placed in a care centre.

Woman Delivers Baby Girl on Train in Andhra Pradesh

Andhra Pradesh : A pregnant woman gave birth to a baby girl on a moving train in Andhra Pradesh. The incident ended safely with the help of railway staff.

The woman was eight months pregnant. She boarded the train with her family, believing she still had one month left for delivery. She was travelling from Chennai to Dhanbad on Train No. 13352.

After the train crossed Annavaram station, she began to feel labour pain. Her family members became worried and immediately informed the ticket examiner.

Railway staff member G. Jyothi responded quickly and helped the woman. Understanding the emergency, the train was given a special halt at Elamanchili station. An ambulance was also arranged.

The woman delivered a healthy baby girl on the train. After the delivery, both the mother and the newborn were shifted to Elamanchili Government Hospital in a 108 ambulance.

Officials confirmed that both the mother and baby are safe and healthy. The train was halted at the station for about 40 minutes to manage the situation.

Railway staff ensured privacy by asking male passengers to leave the coach. Their timely action helped ensure a safe delivery.

This incident highlights the importance of quick response and human support during emergencies.
