SC Requests Chief Justice of Allahabad HC to Refrain from Assigning Judicial Duties to Justice Varma

Published

on

On Friday, the Supreme Court instructed the Chief Justice of the Allahabad High Court to refrain from assigning any judicial responsibilities to Justice Yashwant Varma when he officially takes up his position as a Judge of the Allahabad High Court. A press release from the Supreme Court confirmed this directive, stating, “The Chief Justice of the Allahabad High Court has been asked not to assign any judicial work to Justice Yashwant Varma upon his appointment.”

The Central Government has formally issued a notification endorsing the Supreme Court collegium’s recommendation to transfer Justice Varma from the Delhi High Court to the Allahabad High Court. This notification elaborates that, in line with Article 222(1) of the Constitution of India, the President, after consulting with the Chief Justice of India, has approved the transfer of Justice Yashwant Varma to his new role in the Allahabad High Court.

Justice Varma’s transfer occurs amid allegations concerning the discovery of a substantial amount of unaccounted cash in the outhouse of his official residence in New Delhi, which emerged after a fire incident on March 14, 2025. Firefighters extinguishing the blaze found the cash.

In response, Chief Justice of India, Justice Sanjiv Khanna, has established a three-member inquiry committee to investigate the matter. This committee includes Justice Sheel Nagu, Chief Justice of the Punjab and Haryana High Court, Justice GS Sandhawalia, Chief Justice of the Himachal Pradesh High Court, and Justice Anu Sivaraman from the Karnataka High Court.

Justice Varma has categorically denied any wrongdoing, asserting that neither he nor his family had placed the cash in the storeroom. The controversy has significantly affected his position at the Delhi High Court; notably, he was excluded from the recently restructured administrative committees, and his judicial responsibilities were removed following an order from the Chief Justice of India.

Despite the timing of the cash discovery and his transfer recommendation, the Supreme Court has clarified that the decision is separate from the ongoing investigation. In light of the cash recovery, the inquiry committee’s formation, and Justice Varma’s transfer, the Allahabad High Court Bar Association has initiated an indefinite strike, expressing their disapproval of the Collegium’s recommendation regarding Justice Varma’s transfer to the Allahabad High Court.
