SC Emphasizes Importance of Creativity: Gujarat Police’s FIR Against Congress MP for Poem Under Scrutiny

Published

on

On Monday, the Supreme Court emphasized the significance of creativity while extending interim protections for Congress Member of Parliament Imran Pratapgarhi, who is facing allegations from the Gujarat Police of inciting communal discord through a video of his poem shared on social media.Justice Abhay S. Oka, leading a bench that included Justice Ujjal Bhutan, urged the Gujarat Police to consider the essence of the poem, stating, “Ultimately, creativity is also important.” He clarified, “At its core, this is a poem, not targeted against any religion. The poem conveys the message that even if violence occurs, we will not respond with violence. Its message is not directed against any specific community.”

The bench provided the Gujarat Police additional time to respond to Pratapgarhi’s challenge against the January 17, 2025, Gujarat High Court decision, which declined to quash the FIR filed against him. The next hearing is scheduled for March 3, 2025, during which the bench questioned the justification for the FIR regarding Pratapgarhi’s post featuring the poem “ae khoon ke pyase baat suno…”

Previously, on January 21, 2025, while issuing a notice to the Gujarat government, the Supreme Court ordered that no coercive measures be taken against Pratapgarhi based on FIR No. 11202008250014, filed on January 3, 2025, at the City A-Division Police Station in Jamnagar.

Imran Pratapgarhi, who serves as the national chairman of the Congress Minority Cell, was accused by the Jamnagar Police of fostering hostility among various groups based on religion and race, making statements harmful to national unity, and inciting public offenses, among other charges. The FIR stemmed from a 46-second video he shared on December 29, which featured the poem “ae khoon ke pyase baat suno…” as a backdrop.

A complaint from a Jamnagar resident claimed that his use of the song was “provocative, harmful to national integrity, and offensive to religious sentiments.” In response, Pratapgarhi approached the High Court to have the FIR annulled, asserting that the poem was intended to promote a message of love.

However, on January 17, 2025, the High Court refused to dismiss the FIR, citing the necessity of further investigation and noted that Pratapgarhi had not cooperated with the inquiry.
