Madras HC Rejects Petition for Appointment of Temple Trustee Based on Caste Preference

Published

on

The Madras High Court has declared unconstitutional any request that would perpetuate the caste system, dismissing a petition aimed at appointing non-hereditary trustees for two specific temples associated with a particular sub-caste. Justice D. Bharatha Chakravarthy, while rejecting the plea, noted that such actions would hinder the constitutional objectives and contradict public policy. The judge expressed disappointment at society’s persistent adherence to caste distinctions, even after 75 years of constitutional progress. The petitioner, A. Rajendran, argued that the Varadharaja Perumal Temple and Sendraya Perumal Temple, both Vaishnavite shrines, belonged to a specific sub-caste within the community. He sought intervention from the Joint Commissioner of the Hindu Religious and Charitable Endowment Department in Coimbatore to establish a framework for the administration of these temples by appointing non-hereditary trustees from his sub-caste.

The judge remarked, “Despite seventy-five years of our Constitution, certain segments of society still cling to this outdated notion. The very essence of the Constitutional framework is undermined, and the caste system contradicts the goals and values we aspire to.”

He further stated, “Any petition aimed at perpetuating caste is not only unconstitutional but also contradicts public policy. It is imperative for this court to make a clear declaration on this issue.”

Furthermore, the court emphasized that caste is a societal issue that should not be supported or maintained by the judiciary. The determination of one’s caste should not be based on birth but on individual merit, underscoring the belief that all individuals are born equal. Accepting caste-based petitions would be fundamentally against the principles enshrined in the Constitution.

Jawan at the Indo-Pak Border Appeals to Protect His Land from Encroachers

Sure! Here’s a rewritten version of the content:

An Indian Army soldier stationed at the India-Pakistan border in Jammu and Kashmir has shared a video on social media, accusing the family of a village revenue officer (VRO) of illegally taking over his ancestral land in Siddipet district, Telangana. He has called for viewers to spread the video to reach Chief Minister A. Revanth Reddy, claiming that higher authorities have remained inactive due to the VRO’s influence. Following the video’s widespread circulation, BRS leader and Siddipet MLA T. Harish Rao urged the district collector, M. Manu Chowdary, to take immediate action.

In his video, Army jawan B. Rama Swamy alleges that while he was away serving the nation, individuals encroached upon his 1.16 acres of agricultural land located in Chowdarpally, under the Akberpet-Bhumpally mandal. He accuses VRO Ramesh’s family of orchestrating this land grab during the previous administration. This situation echoes the story of Paan Singh Tomar, an army veteran who turned into a rebel to protect his agricultural land from encroachers.

The jawan has reported that his family has faced harassment from the encroachers, who are related to the VRO. They allegedly manipulated land records to remove the jawan’s family members and altered ownership details. Despite approaching the mandal revenue officer and the revenue divisional officer over the past six years, the family has been unsuccessful in securing justice due to the VRO’s powerful connections. After the video gained traction, people called for accountability, prompting MLA T. Harish Rao to publicly request thorough investigation and corrective measures, stating, “It’s shocking that a soldier, who protects our borders, has to endure such a situation.”

Minor Girl Goes Missing in Uttarakhand; VHP and Bajrang Dal Label It as Love Jihad and Demand Demolition of Suspect’s Home

The inability of Uttarakhand police to find a 14-year-old girl, reportedly enticed by a 24-year-old man from a different community, has sparked unrest among locals and right-wing groups in Udham Singh Nagar. Members of the Vishwa Hindu Parishad (VHP) and Bajrang Dal are claiming this incident as a case of “love jihad” and have called for the man’s house to be demolished.

Despite assurances from the police that they are working to locate the girl, right-wing organizations argue that after more than 19 days, there has been no progress in tracing either her or the man involved. They raised concerns, asking, “How can the police have no leads on a girl who disappeared 19 days ago, on April 28, from the Kelakheda area of Udham Singh Nagar?”

On Friday, angry VHP and Bajrang Dal activists protested outside the Kelakheda police station, insisting on the destruction of the man’s house, who is reportedly a barber in the same neighborhood. The protesters, despite ongoing discussions with police officials, refused to leave until BJP MLA from Rudrapur, Shiv Arora, intervened and addressed their concerns. Arora assured them that the authorities would soon find both the missing girl and the man accused of luring her away. The right-wing activists warned they would escalate their actions if the girl wasn’t found promptly.

According to Udham Singh Nagar SSP Manikant Tiwari, the girl was allegedly lured away on April 28 by a 24-year-old barber. Following a complaint from her parents, police registered a missing person’s report. The girl’s father has accused the man of kidnapping her. On April 30, VHP and Bajrang Dal representatives, led by Yashpal Rajhans of the VHP Gau Raksha Dal, approached the police demanding urgent action to retrieve the minor. Rajhans claimed the man is connected to a wider “love jihad” network in the state.

In response to inquiries, SSP Tiwari stated, “The missing girl is 14 years old, and all necessary efforts are underway to recover her and the man who allegedly took her. We have interrogated the man’s family and friends and deployed teams to various locations based on leads from the investigation. We are close to determining their whereabouts, and the police will bring them back soon.”
