Controversy Surrounds J’khand DGP Appointment for Breaching SC Order

Published

on

The appointment of Jharkhand’s Director General of Police (DGP) has ignited a political uproar in the state. Babulal Marandi, the BJP state president and former chief minister, has expressed strong opposition to Anurag Gupta’s designation as the state’s regular DGP, labeling it a breach of Supreme Court guidelines. He has called on the Jharkhand High Court to take suo motu notice of the issue.

The BJP contends that the Hemant Soren administration has appointed a controversial figure to this crucial role while ignoring established protocols. Marandi emphasized that on January 7, the state cabinet had agreed to establish a selection committee, which would include a retired judge, the Chief Secretary, a member of the Public Service Commission, and the chairman of the JPSC, tasked with shortlisting candidates for the DGP position.

However, the government bypassed this procedure and appointed Gupta directly. Citing the Supreme Court’s directive from 2006, BJP leaders contended that DGP appointments should rely on recommendations from the State Public Service Commission unless explicit laws allow otherwise. They accused the Jharkhand government of disregarding these regulations by installing Gupta without following the proper selection process.

Additionally, the BJP has raised alarms about Gupta’s past conduct, alleging his involvement in electoral irregularities during the 2024 assembly elections. Marandi has demanded that the CBI investigate Gupta’s tenure, questioning why an officer dismissed by the Election Commission has been reinstated as DGP.

In spite of the ongoing controversy, the Jharkhand government has officially announced Anurag Gupta’s appointment as the regular DGP. A 1990-batch IPS officer, Gupta previously served as the Director General of Crime Investigation and acted as DGP before his appointment.

This situation isn’t the first instance of a contentious DGP appointment in Jharkhand. During the 2024 assembly elections, Anurag Gupta was replaced by Ajay Kumar Singh by the Election Commission. However, following the return of Hemant Soren’s government, Gupta was reinstated as acting DGP and has now secured a permanent position.

With the BJP advocating for judicial examination, the attention now turns to the Jharkhand High Court. Will it take suo motu notice of the situation? Does Gupta’s appointment contravene the Supreme Court’s 2006 ruling? As legal and political disputes unfold, the controversy appears far from resolved.
