Centre Informs SC That Deportation of Foreigners from Assam is Being Reviewed at the Highest Level

Published

On Tuesday, the Central government informed the Supreme Court that the matter of deporting individuals identified as foreigners in Assam is currently being reviewed at the “highest executive level.” Solicitor General Tushar Mehta, representing the government, conveyed to a bench comprising Justice Abhay S. Oka and Justice Ujjal Bhuyan that a decision regarding the deportation of these individuals is expected by March 21.

Following the solicitor general’s request, the bench allowed additional time for the Central government to present its decision on deporting foreign nationals who have been declared to be residing illegally in Assam, rescheduling the hearing for March 21.

In a previous hearing on February 4, the Supreme Court admonished the Assam government for failing to initiate deportation processes for those identified as foreigners and for their practice of holding these individuals in detention centers indefinitely. The Court directed the state to commence deportation for 63 foreign nationals currently held in detention centers within two weeks, challenging the state’s argument that deportation was hindered by a lack of disclosed addresses.

The bench remarked, “You have declined to begin deportation because their addresses are unknown. Why should that concern us? You can deport them to their home countries. Are you waiting for an auspicious moment? Deportation can occur without an address; indefinite detention is unacceptable.”

The bench emphasized, “Once individuals are classified as foreigners, they should be deported without delay. Their citizenship status is already determined, so why wait for an address? It is the responsibility of the foreign country to decide their destination.”
