BJP Announces Legal Challenge Against 4% Muslim Reservation in Karnataka Government Contracts

Published

on

On Tuesday, the BJP announced its intention to legally contest the controversial 4% reservation for Muslims in government contracts, following the Karnataka government’s introduction of the Karnataka Transparency in Public Procurement (Amendment) Bill, 2025. This bill aims to amend the Karnataka Transparency in Public Procurement (KTPP) Act of 1999 to implement the reservations outlined in the state’s budget.

The bill, introduced by Minister for Law and Parliamentary Affairs HK Patil, is set for discussion as per the Speaker’s approved schedule. The government has solidified its commitment to providing reservations for minority communities, a decision that was sanctioned by the state cabinet last Friday. In a prompt move, the government presented the bill, which proposes reserving 4% of civil works contracts valued up to ₹2 crore and goods and services contracts up to ₹1 crore specifically for Muslims. Similar reservation policies already exist, with provisions for SCs (17.5%), STs (6.95%), and OBCs Category 1 (4%) and Category 2 (15%).

The legislation aims to tackle unemployment among marginalized communities and encourage their involvement in government projects. It suggests a 4% reservation for Category 2B (Muslims) in civil contracts up to ₹2 crore and extends comparable measures to the procurement of goods and services in specific government departments for contracts up to ₹1 crore.

Following the cabinet’s approval, BJP leadership at both the state and national levels launched a strong critique of the Congress party’s alleged appeasement policies. A BJP MP in Delhi asserted, “We will continue our fight in the courts,” referencing prior Supreme Court rulings regarding reservations based on religion.

In response to BJP’s criticisms, State IT and Panchayati Raj Minister Priyank Kharge posed a pointed question: “If the BJP is opposed to Muslims, why haven’t they declared them non-citizens? Until such a declaration is made, it is our government’s responsibility to uplift people from economically disadvantaged backgrounds,” stated the Karnataka minister.
